Now Serving Sweepstakes Terms & Conditions
These are the official rules (“Official Rules”) that govern the Now Serving Sweepstakes (“Sweepstakes”) and the relationship between participants (“Entrants”) and the Promoter (as defined below).
By participating in the Sweepstakes, Entrants confirm they have legal capacity to enter and agree to comply with and be bound by these Official Rules. No purchase necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning.
This promotion is in no way sponsored, endorsed, or administered by, or associated with, X Corp., Facebook, Instagram, or any other social-media platform. You are providing your information to the Promoter, not to those platforms.
1. Promoter & Website
1.1. The Promoter of this Sweepstakes is Levy Merchandising, 2nd Floor, Fourways House, 57 Hilton Street, Manchester, M1 2EJ, United Kingdom (“Promoter”). The Promoter is operating this Sweepstakes under a license agreement with ATP Tour, Inc. (“ATP”), and all rights in ATP trademarks, logos, and intellectual property remain the exclusive property of ATP.
1.2. The Website is www.atptourstore.com
2. Eligibility
2.1. Eligibility is limited to legal residents of the United Kingdom and the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or the age of majority in their place of residence, whichever is older, at the time of entry. Void elsewhere and where prohibited by law.
2.2. Sweepstakes is not available to persons who reside in countries which are subject to United States export embargo (each, an “embargo country”). As of May 2025, embargoed countries include Cuba, Iran, North Korea, Syria, and the Crimea/Donetsk/Luhansk regions of Ukraine. This list is subject to change, and entrants are responsible for ensuring compliance with current U.S. export control laws.
2.3. To the fullest extent permitted by law, it is the entrant’s sole responsibility to confirm that participation in the Sweepstakes is permitted under the law of his/her jurisdiction of residence.
2.4. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for the Promoter, or any organizations responsible for Promoting, fulfilling, administering, advertising or promoting the Sweepstakes or awarding the prize and/or their respective parent, subsidiary, affiliated, and successor companies (collectively, the “Promotion Entities”), and immediate family and household members of such individuals, are not eligible to enter or win the prize. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three (3) months a year, whether related or not.
2.5. Entrants must have internet access and a valid and active email address.
3. Sweepstakes Period
3.1. The Sweepstakes begins at 09:00 (UK time) on Monday 12th January 2026 and ends at 23:59 (UK time) on Sunday 8th February 2026 (the “Promotion Period”).
3.2. The Promoter’s computer shall serve as the official time-keeping device for this Sweepstakes.
4. How to Enter
4.1. During the Promotion Period, visit www.atptourstore.com and complete the Now Serving homepage sign-up form by providing your email address.
4.2. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties are prohibited.
4.3. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified.
4.4. Following the above steps signifies that you meet the Sweepstakes eligibility requirements and have read and agree to these Official Rules.
4.5. No purchase is necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning.
4.6. Limit one (1) entry per person/email address. No bonus entries are available for marketing opt‑in for this Sweepstakes. Multiple entries and/or mass entry attempts in excess of the preceding limit will result in disqualification of all entries by such person; and, if violation is determined by the Promoter to be particularly egregious and/or repeated, such person may be prohibited from participating in subsequent Sweepstakes or promotions which may be offered by the Promoter during calendar year 2026.
4.7. Proof of submitting an entry does not constitute proof of receipt by the Promoter.
4.8. In case of a dispute over the identity of an Entrant, the authorised/authorized account holder of the e-mail address used to enter will be deemed to be the Entrant. “Authorised/authorized account holder” is defined as the person who is assigned to an e-mail address by an internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
4.9. Entries that are incomplete, garbled, corrupted, jumbled, inaccessible, improperly recorded (or not recorded at all) or unintelligible for any reason are void and will not be accepted.
4.10. If you choose to participate in the Sweepstakes by using your wireless mobile device, data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers' rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Sweepstakes. Mobile device service may not be available in all areas. Check your phone's capabilities for specific instructions. The Promoter will not reimburse any charges incurred by entrants to participate in the Sweepstakes.
4.11. Participation constitutes full and unconditional agreement to these Official Rules and to the Promoter’s decisions, which are final and binding in all matters related to the Sweepstakes.
4.12. Notice of any termination, modification, or suspension of the Sweepstakes will be posted on the Website.
5. Prize
5.1. One (1) winner will receive a £250 voucher (or equivalent value in local currency) redeemable at www.atptourstore.com (the “Prize”).
5.2. The £250 voucher is valid for 12 months from the date of issue, is non-transferable, non-exchangeable, cannot be sold, and is not redeemable for cash.
5.3. Standard ATP Tour Store terms of sale and voucher redemption conditions apply.
5.4. If the specified prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter reserves the right to substitute the prize with another item of equal or greater value.
5.5. The Promoter accepts no responsibility for any loss or damage arising from the winner’s acceptance or use of the prize.
5.6. The winner is solely responsible for any applicable taxes, duties, or fees in their jurisdiction unless prohibited by law.
5.7. Unspecified expenses in conjunction with claiming, accepting and using the Prize as well as any applicable taxes on the Prize are the winner’s sole responsibility.
6. Winner Selection and Odds
6.1. The winner will be selected at random, using a computer-generated random selection tool, from all eligible entries received during the Promotion Period. The winner’s surname and county/region and country of residence will be made available on request unless the winner objects. To request these details, send a self-addressed envelope or email request to support.atpstore@levymerch.com within 30 days of the end of the Promotion Period. If the winner objects, the Promoter may still provide such information to regulators upon request.
6.2. The draw will take place within five (5) business days following the end of the Promotion Period.
6.3. Odds of winning depend on the total number of eligible entries received.
7. Winner Notification and Verification
7.1. The potential winner will be notified by email at the address used for entry within seven (7) days of the draw.
7.2. The winner must respond within seven (7) days of notification. If the potential winner cannot be contacted, fails to respond, or is found to be ineligible, the Promoter reserves the right to select an alternate winner. There will be no more than one (1) additional draw if the winner cannot be contacted.
7.3. The potential winner must complete and return, within three (3) business days of notification, an eligibility declaration/certificate, a liability release, and a publicity release where lawful (collectively, ‘Winner Documents’). Failure to timely return the Winner Documents, failure to respond, or any determination of ineligibility may result in forfeiture, in which case an alternate winner may be selected.
7.4. By accepting the prize (except where prohibited by law), the winner consents to the Promoter and its designees using the winner’s name, city/region/country, likeness, image and/or voice for advertising, promotion and publicity purposes in any and all media now or hereafter known, worldwide, in perpetuity, without further compensation, notification, permission, or approval.
7.5. For United States residents only: The potential winner will be required to consent to a background check to verify eligibility. Failure to provide such consent and any information reasonably required for the background check will result in disqualification. The Promoter reserves the right, in its sole discretion, to disqualify a potential winner based on the results of a background check (e.g., a conviction for a felony or crime of moral turpitude), where permitted by law.
7.6. All applicable federal, state, provincial, local, and foreign taxes are the sole responsibility of the winner except where prohibited by local law. If the winner is a U.S. resident, the winner will receive an IRS Form 1099 reflecting the actual value of the prize (if valued at USD $600 or more). If the winner is not a U.S. resident, the winner may receive IRS Forms 1042‑S and/or W‑8BEN (or other applicable forms), and U.S. foreign withholding may apply in addition to any taxes that may be levied by the winner’s country of residence.
8. Prize Delivery
8.1. Once verified, an E-Gift card will be issued via email within ten (10) business days of winner confirmation. The E-Gift card may be subject to local currency conversion at the prevailing rate on the date of issue.
9. Data Protection and Privacy
9.1. The Promoter collects personal information (including name, email address, and country of residence) from entrants for the purpose of administering the Sweepstakes, contacting the winner, and sending promotional communications about the Promoter’s products, offers, and retail updates to entrants who have opted in. The Promoter and ATP are each controllers of personal data collected for the administration of the Sweepstakes. Personal data may be transferred outside the UK/EEA (including to the United States). Where such transfers occur, the Promoter will implement appropriate safeguards to ensure an adequate level of protection as required by applicable law.
9.2. All personal data will be processed in accordance with the Promoter’s Privacy Policy and ATP’S Privacy Policy (https://www.atptour.com/en/privacy-policy), and in compliance with applicable data protection laws, including the UK GDPR and the EU GDPR.
9.3. On the competition entry page, entrants are informed:
“We’ll use your email to contact you if you win and, if you opt in, to send occasional updates about our products, offers, and promotions. We’ll never share your data with third parties for marketing purposes.”
9.4. Marketing opt-in is voluntary and is not a condition of entry. Entrants may withdraw consent at any time without affecting their eligibility or entries.
9.5. Personal data may be transferred to countries outside the United Kingdom or European Economic Area, including the United States, where data protection standards may differ. In all cases, the Promoter will implement appropriate safeguards to ensure that personal data remains protected in accordance with applicable law.
9.6. Entrants have the right to access, correct, delete, or restrict the processing of their personal data, and to withdraw consent for marketing communications at any time without affecting their eligibility for the Sweepstakes. These rights may be exercised by contacting the Promoter at the address or email provided at www.atptourstore.com
9.7. Personal data will be retained only for as long as necessary to administer the Sweepstakes, fulfil any Prize obligations, or for marketing purposes, and will otherwise be securely deleted.
10. General Conditions and Limitations of Liability
10.1. Nothing in these Official Rules excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Official Rules would contravene any statute or cause any part of these Official Rules to be void (“Non-Excludable Guarantees”) or any other liabilities which shall not be excluded under mandatory local law or public policy. Subject to the foregoing, the Promoter excludes from these Official Rules all conditions, warranties and terms implied by statute, general law or custom.
10.2. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or technical failures beyond the Promoter’s control that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the Entry process. In such event, Promoter reserves the right to conduct the Sweepstakes and award the Prize by means of a random drawing from among all eligible Entries received prior to and/or after (as appropriate) the action taken by Promoter or otherwise in a manner which is fair, appropriate, and consistent with these Official Rules, as determined by Promoter in its sole discretion. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of Entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or Entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any person's computer or mobile device related to or resulting from participation in or downloading any materials from this Sweepstakes. Failure of the Promoter to enforce any provision of these Official Rules shall not constitute the waiver of such provision.
10.3. You agree not to damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. Any attempt to damage any online service or website or undermine the legitimate operation of the Sweepstakes violates criminal or civil laws. If such an attempt is made, the promoter may disqualify any person making such attempt and prevent such person from participating in subsequent versions of the Sweepstakes for different ATP Tour Store competitions.
10.4. The Promoter reserves the right to cancel, suspend, or amend the Sweepstakes or these Official Rules if circumstances beyond its reasonable control make it necessary to do so. The Promoter is not liable for events outside its reasonable control, including but not limited to natural disasters, acts of God, war, or strikes.
10.5. The Promoter accepts no responsibility for late, lost, incomplete, corrupted, or misdirected entries or for any technical or human error.
10.6. Except where prohibited by law, Entrants agree to release and hold harmless the Promoter, its affiliates, officers, employees, and agents from any and all liability, injury, loss, or damage of any kind arising in connection with participation or acceptance of the Prize.
10.7. Nothing in these Official Rules excludes or limits liability for death or personal injury caused by negligence, fraud, or any matter which cannot be excluded under applicable law.
10.8. The Promoter reserves the right to disqualify any Entrant found to be tampering with the entry process or in breach of these Rules.
10.9. Subject to any Non-Excludable Guarantees and any liabilities that cannot be excluded under mandatory local law or public policy, entrants agree to release and hold harmless the Promoter, ATP Tour, Inc., and their respective affiliates, officers, employees, and agents, as well as Meta Platforms, Inc. and X, Corp., Facebook, Instagram, or any other social-media platform (collectively, the ‘Released Parties’) from any and all actions, claims, injury, loss, or damage of any kind arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance, receipt, possession, use, or misuse of the prize.
11. Governing Law and disputes:
11.1. For entrants who are legal residents of the United Kingdom: These Terms and the Sweepstakes shall be governed by the laws of England and Wales, and the parties submit to the nonexclusive jurisdiction of the courts of England and Wales.
11.2. For entrants who are legal residents of the United States: These Terms and the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Delaware, U.S.A., without regard to its conflict of laws principles, and the parties submit to the nonexclusive jurisdiction of the state and federal courts located in Delaware. Except where prohibited, each entrant agrees that any disputes shall be resolved individually, without resort to any form of class action; that any claims, judgments or awards shall be limited to actual out-of-pocket costs (excluding attorneys’ fees); and that, to the extent permitted by compulsory local law, entrants waive the right to claim indirect, punitive, incidental, or consequential damages and any right to have damages multiplied or otherwise increased.
11.3. Nothing in these Terms excludes or limits liability for Non-Excludable Guarantees or any other liabilities which cannot be excluded under mandatory local law or public policy. For the avoidance of doubt, "Non-Excludable Guarantees" means consumer guarantees or warranties that cannot be excluded, restricted or modified under applicable consumer protection laws.

Requests must be received within 30 days after the end of the Promotion Period. Where the winner objects to public disclosure, the Promoter will provide such information to regulators upon request and may be required to disclose such information as required by applicable law or legal process.
13. Additional Notices
13.1. If these Terms are translated into another language and there is any discrepancy between the English version and a translated version, the English version shall prevail to the extent permitted by applicable law.
